The department shall issue a license for the operation of an agency providing services to individuals with a developmental disability upon a showing that: 1. The premises to be used are safe, sanitary, and properly equipped to provide good care; 2. The persons in charge of the provider agency, including their assistants, are qualified by training and experience to carry on efficiently the duties required of them; 3. The health, safety, and well-being of individuals receiving services are protected; 4. A variety of meaningful activities , treatment, educational opportunities , and physical facilities are available; 5. Appropriate arrangements are made for a medical and psychological examination of each individual; and 6. The provider is in compliance with rules adopted by the department under this chapter.
