1. A person may not construct, install, modify, use, or operate an air contaminant source 
designated by regulation, capable of causing or contributing to air pollution, either 

directly or indirectly, without a permit from the department or in violation of any 
conditions imposed by the permit.
2. The department shall provide for the issuance, suspension, revocation, and renewal of 
permits that it requires under this section.
3. The department may require applications for permits to be accompanied by plans, 
specifications, and other information it deems necessary.
4. Possession of an approved permit or registration certificate does not relieve any 
person of the responsibility to comply with applicable emission limitations or with any 
other law or rule, and does not relieve any person from the requirement to possess a 
valid contractor's license issued under chapter 43-07.
5. The department by rule may provide for registration and registration renewal of certain 
air contaminant sources in lieu of a permit.
6. The department may exempt by rule certain air contaminant sources from the permit 
or registration requirements in this section when the department makes a finding the 
exemption will not be contrary to section 23.1-06-02.
