1. The state fire marshal may adopt rules to implement this chapter. 2. The state tax commissioner in the regular course of conducting inspections of wholesale dealers, agents, and retail dealers, as authorized under chapter 57 -36, may inspect such cigarettes to determine if the cigarettes are marked as required by section 18 -13-04. If the cigarettes are not marked as required, the state tax commissioner shall notify the state fire marshal.
