Where an offense is defined by a statute or by the constitution without specification of its classification pursuant to section 12.1 -32-01, the offense is punishable as provided in the statute or constitutional provision defining it, or: 1. If the offense is declared to be a felony, without further specification of punishment, it is punishable as if it were a class C felony. 2. If the offense is declared to be a misdemeanor, without further specification of punishment, it is punishable as if it were a class A misdemeanor. The sentencing alternatives available under section 12.1 -32-02 are available to a court sentencing an offender for commission of an offense defined by a statute outside this title.
