* § 1640-p. Pilot residential parking permit system in the city of\nBuffalo. 1. Notwithstanding the provisions of any law to the contrary,\nthe city of Buffalo may, by adoption of a local law or ordinance,\nprovide for a residential parking permit system and fix and require the\npayment of fees applicable to parking within the area in which such\nparking system is in effect in accordance with the provisions of this\nsection.\n 2. Such residential parking permit system may only be established\nwithin the area of the city of Buffalo consisting of the following\nroadways:\n (a) Maple Street, from BFNC Drive to North Street;\n (b) Mulberry Street, from BFNC Drive to North Street;\n (c) Locust Street, from BFNC Drive to North Street;\n (d) Lemon Street, from BFNC Drive to North Street;\n (e) Orange Street, from BFNC Drive to North Street;\n (f) Peach Street, from BFNC Drive to North Street;\n (g) Grape Street, from BFNC Drive to North Street;\n (h) Rose Street, from BFNC Drive to North Street;\n (i) High Street, from Michigan Avenue to Rose Street;\n (j) Carlton Street, from Maple Street to Rose Street;\n (k) Virginia Street, from Maple Street to BFNC Drive; and\n (l) North Street, from Maple Street to Rose Street.\n 3. Notwithstanding the foregoing, no permit shall be required on\nstreets where the adjacent properties are zoned for commercial, office\nand/or retail use.\n 4. The local law or ordinance providing for such residential parking\npermit system shall:\n (a) Set forth factors necessitating the enactment of such parking\nsystem;\n (b) Provide that motor vehicles registered pursuant to section four\nhundred four-a of this chapter shall be exempt from any permit\nrequirement;\n (c) Provide the times of the day and the days of the week during which\npermit requirements shall be in effect;\n (d) Make not less than twenty percent of all spaces within the permit\narea available to nonresidents and shall provide short-term parking of\nnot less than ninety minutes in duration in such area;\n (e) Provide the schedule of fees to be paid for such permits; and\n (f) Provide that such fees shall be credited to the general fund of\nthe city of Buffalo.\n 5. No ordinance shall be adopted pursuant to this section until a\npublic hearing thereon has been had in the same manner as required for\npublic hearings on a local law pursuant to the municipal home rule law.\n * NB Repealed December 31, 2026\n
