New York Transportation Code § 190

§ 190. Application of article. This article shall apply to common\ncarriers of property by motor vehicle transporting household goods.  The\nprovisions of this article shall not apply to:\n  (a) the transportation of household goods by or for the federal, state\nor municipal governments;\n  (b) the occasional, casual or reciprocal transportation of household\ngoods by any person not engaged in the transportation of household goods\nas a regular occupation or business;\n  (c) the transportation of household goods as defined in paragraph (c)\nof subdivision fifteen of section two of this chapter when such\ntransportation is wholly within a municipality or between contiguous\nmunicipalities or within a commercial zone as defined by the\ncommissioner that is adjacent to and commercially a part of any\nmunicipality or municipalities except when such transportation is under\na common control, management, or arrangement for a continuous carriage\nor shipment by motor vehicle to or from a point outside of such\nmunicipality, municipalities or commercial zone;\n  (d) the transportation of household goods as defined in paragraph (c)\nof subdivision fifteen of section two of this chapter when such\ntransportation is performed by a common or contract carrier of property\nby motor vehicle authorized to transport such articles pursuant to\narticle eight of this chapter; or\n  (e) the transportation of household goods in private carriage when\nsuch transportation is incidental to and in furtherance of a primary\nbusiness enterprise of such person other than transportation.\n
