§ 107. Use of streets; municipal consent. Every such freight terminal\ncorporation may acquire, use and enjoy the privilege to cross or\notherwise use the streets adjacent to any terminal way or terminal\nstation with the consent and on such terms as may be imposed by the\nlocal authority in control thereof, and subject to the approval of the\ncommissioner of transportation. If such approval be granted, the\ncommissioner of transportation shall issue a certificate (1) that such\nprivilege is needed for public use; (2) that the exercise of such\nprivilege will leave the street in the main available for ordinary\nstreet uses; and (3) that the exercise of such privilege will enhance\nand improve the service afforded by such street to the public. Such\nprivilege shall be revocable by the city on such notice, not exceeding\none year, as may be specified therein; but such revocation shall not be\neffective unless the commissioner of transportation approve of the same\nand certify that such privilege is no longer needed for public use or\nthat the exercise of such privilege has failed to enhance or improve the\nservice afforded by such street to the public.\n
