Responsibility to respond to the freedom of information law for certain data

§ 106. Responsibility to respond to the freedom of information law for\ncertain data. Where the office receives a request for another agency's\ndata which is in the possession of the office because it administers,\noperates or manages a statewide technology program, the office will\ntransmit, within five days, in writing the request to the agency that\nowns the data with a copy of this law and send a copy of the transmittal\nto the requester. Upon receiving the forwarded request, the agency must\ncomply with article six of the public officers law as if it had\ninitially received the request. The time periods for responding to a\nrequest as required by article six of the public officers law commence\nwhen the agency receives the request from the office.\n
