§ 99-ll. New York state council on the arts cultural programs fund. 1.\nThere is hereby established in the joint custody of the state\ncomptroller and commissioner of taxation and finance a special fund to\nbe known as the "New York state council on the arts cultural program\nfund".\n 2. Such fund shall consist of all revenues received by the state,\npursuant to the provisions of section twenty-four-c of the tax law and\nall other moneys appropriated thereto from any other fund or source\npursuant to law. Nothing contained in this section shall prevent the\nstate from receiving grants, gifts or bequests for the purposes of the\nfund as defined in this section and depositing them into the fund\naccording to law.\n 3. On or before the first day of February two thousand twenty-four,\nthe executive director of the New York state council on the arts shall\nprovide a written report to the temporary president of the senate, the\nspeaker of the assembly, the chair of the senate finance committee, the\nchair of the assembly ways and means committee, the chair of the senate\ncommittee on health, the chair of the assembly health committee, the\nstate comptroller and the public. Such report shall include how the\nmonies of the fund were utilized during the preceding calendar year, and\nshall include:\n (a) the amount of money disbursed from the fund and the award process\nused for such disbursements;\n (b) recipients of awards from the fund;\n (c) the amount awarded to each;\n (d) the purposes for which such awards were granted; and\n (e) a summary financial plan for such monies which shall include\nestimates of all receipts and all disbursements for the current and\nsucceeding fiscal years, along with the actual results from the prior\nfiscal year.\n 4. Moneys shall be payable from the fund on the audit and warrant of\nthe comptroller on vouchers approved and certified by the executive\ndirector of the New York state council on the arts.\n 5. The moneys in such fund shall be expended for the purpose of\nsupplementing art and cultural grant programs of the New York state\ncouncil on the arts, including but not limited to: arts education\nprograms, and art and cultural programs for children and adults,\nincluding programs that increase access to art and cultural programs and\nevents in underserved communities.\n
