Animal population control fund

§ 97-xx. Animal population control fund. 1. There is hereby\nestablished in the joint custody of the state comptroller and the\ncommissioner of taxation and finance a fund to be known as the "animal\npopulation control fund".\n  2. Such fund shall consist of all moneys collected pursuant to\nsubdivision three of section one hundred ten of the agriculture and\nmarkets law, and section one hundred seventeen-a of the agriculture and\nmarkets law, and all other moneys credited or transferred thereto from\nany other fund or source pursuant to law.\n  3. Moneys of the fund shall be expended for the purposes of carrying\nout the provisions of section one hundred seventeen-a of the agriculture\nand markets law. Moneys shall be paid out of the fund on the audit and\nwarrant of the state comptroller pursuant to subdivision four of this\nsection. Any interest received by the comptroller on moneys on deposit\nin the animal population control fund shall be retained in and become\npart of such fund.\n  4. The comptroller shall disperse the full balance of funds accrued\npursuant to subdivision two of this section to the administering entity\nselected pursuant to subdivision one of section one hundred seventeen-a\nof the agriculture and markets law on a quarterly basis for the purposes\nof administering the animal population control program established\npursuant to such section.\n
