§ 97-s. Nelson A. Rockefeller Empire State Plaza performing arts\ncenter corporation fund. 1. There is hereby established in the custody\nof the commissioner of taxation and finance a special account to be\nknown as the "performing arts center corporation fund".\n 2. All moneys of the corporation received in accordance with\nsubdivision four of this section shall be deposited to the credit of\nsuch fund, provided that such deposit is consistent with any contract\nawarded pursuant to chapter six hundred eighty-eight of the laws of\nnineteen hundred seventy-nine as amended by a chapter of the laws of\nnineteen hundred ninety-two. Said moneys shall be kept separate and\nshall not be commingled with any other moneys in the custody of the\ncommissioner of taxation and finance.\n 3. The moneys in said account shall be retained by it and deposited in\na general account and such other accounts as the corporation may deem\nnecessary for the transaction of its business and shall be paid out on\nchecks signed by the chairperson of the corporation or by such other\nmember or officer as the corporation may authorize.\n 4. Notwithstanding any other provision of law, revenues received from\nrentals of the performing arts center and related facilities and revenue\nfrom any other fees and charges and any other funds so designated shall\nbe deposited into this fund.\n
