* § 149. Tower technician protections. 1. Definitions. For the\npurposes of this article, the following terms shall have the following\nmeanings:\n  (a) "State agency" or "state agencies" means all state departments,\nboards, commissions, offices or institutions.\n  (b) "Telecommunications tower" means any freestanding tower, monopole\nor similar structure or facility used for the provision of wireless\nservices including ancillary telecommunications equipment required to\nintegrate such structure or facility into an existing or proposed\nwireless network.\n  (c) "Tower technician" means any telecommunications professional who\ninstalls, repairs, and maintains telecommunications towers and\nequipment.\n  (d) "Contractor" means any person, firm, partnership, corporation,\nassociation, company, organization or other entity, including a\nconstruction manager, general or prime contractor, joint venture, or any\ncombination thereof, which enters into a construction contract with a\nstate agency.\n  (e) "Tower services" means any work performed by a tower technician on\nstate-owned telecommunications towers.\n  2. Tower technician protections. Any construction contract for tower\nservices entered into by a state agency and a private entity shall\ninclude training requirements for all tower technicians performing work\npursuant to the construction contract with the state agency. The\ntraining requirements for tower technicians shall be determined by the\noffice of general services in consultation with any party deemed\nnecessary by the office of general services. Such training requirements\nshall be published on the office of general services website.\n  3. A contractor shall provide confirmation to the state agency that\nall tower technicians performing tower services pursuant to the contract\nhave received the training required by subdivision two of this section\nprior to commencing work pursuant to the contract. Such confirmation\nshall include a list of tower technicians and the dates when each\nrequired training was completed.\n  4. Nothing in this section shall be deemed to diminish the rights,\nprivileges, or remedies of any employee under any collective bargaining\nagreement to the contrary.\n  * NB Effective July 1, 2026\n
