§ 158. Pension contributions returned. 1. Any public official whose\npension is reduced or revoked pursuant to this article shall be entitled\nto a return of his or her contribution paid into the relevant retirement\nsystem, without interest.\n  2. Notwithstanding the provisions of subdivision one of this section,\nno payments in return of contributions shall be made or ordered unless\nand until the supreme court determines that the public official whose\npension has been reduced or revoked has satisfied in full any judgments\nor orders rendered by any court of competent jurisdiction for the\npayment of restitution to the state or a municipality for losses\nincurred as a result of such crime related to public office. If the\nsupreme court determines that such public official whose pension is to\nbe reduced or revoked has failed to satisfy any outstanding judgment or\norder of restitution rendered by a court of competent jurisdiction, it\nmay order that any funds otherwise due to such public official as a\nreturn of contribution, or any portion thereof, be paid in satisfaction\nof such judgment or order.\n
