§ 52-c. Fences in Queens county. Notwithstanding the provisions of\nsection fifty-two or of any other law, general or special, within Queens\ncounty every railroad corporation operating a railroad shall erect and\nthereafter maintain a fence or fences along the boundary line of its\nright of way contiguous and adjacent to a public highway running\ngenerally parallel to or terminating at such boundary line whenever the\ncommissioner of transportation after a hearing on notice to such\nrailroad corporation shall determine it to be necessary for the public\nwelfare and shall by order so direct. The order of the commissioner of\ntransportation may prescribe the height, length, materials and design of\nsuch fence or fences.\n
