§ 246. Approval of plans of corporation. The commission shall not\ngrant to a corporation hereafter formed pursuant to this chapter, a\nlicense to conduct a running or steeplechase race meeting within the\nstate until such corporation shall have submitted to the commission a\nstatement of the location of its proposed grounds and racetrack,\ntogether with a plan of such racetrack, and plans of all buildings,\nseating stands and other structures, in such form as the commission may\nprescribe, and such plans shall have been approved by the commission.\nThe commission at the expense of the applicant may order such\nengineering examination thereof as the commission may deem necessary.\nAlterations of buildings, seating stands or other structures, and the\nerection of new or additional buildings, seating stands or other\nstructures on the grounds of any corporation heretofore or hereafter\nformed pursuant to this chapter may be made only with the approval of\nthe commission and after examination and inspection of the plans thereof\nand the issuance of a permit therefor by such commission. The approval\nof the certificate of incorporation of such corporation shall not be\ndeemed to vest in it the right to a license to conduct running or\nsteeplechase race meetings at such race course or racetrack unless such\ngrounds, track, buildings, seating stands and other structures are\ncompleted in accordance with the plans approved by the commission.\n
