Criminal nuisance in the first degree

§ 240.46 Criminal nuisance in the first degree.\n  A person is guilty of criminal nuisance in the first degree when he\nknowingly conducts or maintains any premises, place or resort where\npersons come or gather for purposes of engaging in the unlawful sale of\ncontrolled substances in violation of section 220.39, 220.41, or 220.43\nof this chapter, and thereby derives the benefit from such unlawful\nconduct.\n  Criminal nuisance in the first degree is a class E felony.\n
