§ 66-w. Finality of charges; small non-residential customers.\nNotwithstanding any other provision of law if a utility corporation or\nmunicipality does not render a small non-residential customer for gas or\nelectric service, with the exception of a seasonal or short-term\ncustomer as defined by rule of the commission, a monthly bill for gas\nand/or electric services used by such customer during that monthly\nperiod, or, in the case of bi-monthly meter reads, during that month and\nthe prior month, within three months from the end date of such monthly\nbilling period, then, such small non-residential customer shall not be\ncharged for such gas and electric services which were not billed to the\ncustomer as provided herein, unless the failure of the corporation or\nmunicipality to bill sooner was not due to the neglect of the\ncorporation or municipality or was due to the culpable conduct of the\ncustomer. The commission shall promulgate regulations necessary to\neffectuate the purposes of this section. For the purposes of this\nsection, "small non-residential customer" means non-residential electric\ncustomers that are non-demand billed customers and non-residential gas\ncustomers that use less than or equal to 750 dekatherms per year. Such\nterm shall not include street lighting accounts.\n
