* § 2899-q. Reporting. 1. The commissioner shall annually review a\nsample of the records maintained under sections twenty-eight hundred\nninety-nine-j and twenty-eight hundred ninety-nine-p of this article.\nThe commissioner shall adopt regulations establishing reporting\nrequirements for physicians taking action under this article to\ndetermine utilization and compliance with this article. The information\ncollected under this subdivision shall not constitute a public record\navailable for public inspection and shall be confidential and collected\nand maintained in a manner that protects the privacy of the patient, the\npatient's family, and any health care provider acting in connection with\nsuch patient under this article, except that such information may be\ndisclosed to a governmental agency as authorized or required by law\nrelating to professional discipline, protection of public health or law\nenforcement.\n  2. The commissioner shall prepare a report annually containing\nrelevant data regarding utilization and compliance with this article and\nshall send such report to the legislature, and post such report on the\ndepartment's website.\n  * NB Effective August 5, 2026\n
