* § 2899-h. Consulting physician responsibilities. Before a patient\nwho is requesting medication may receive a prescription for medication\nunder this article, a consulting physician must:\n 1. examine the patient and such patient's relevant medical records;\n 2. confirm, in writing, to the attending physician and the patient,\nwhether: (a) the patient has a terminal illness or condition; (b) the\npatient is making an informed decision; (c) the patient has\ndecision-making capacity; and (d) the patient is acting voluntarily, of\nthe patient's own volition and without coercion.\n * NB Effective August 5, 2026\n
