§ 2587. Program approval.  1. Eligible institutions seeking cash\nassistance under the program shall submit an application to the\ncommissioner. Such application shall be in a format and quantity\ndetermined by the commissioner, and shall include:\n  (a) a general description of the proposed program;\n  (b) a copy of a valid license or other approval issued by the\ndepartment, the department of social services or other state agency to\nprovide or sponsor child or adult day care programs; and\n  (c) such other information as required by the commissioner.\n  2. The commissioner shall not approve an eligible institution for\nreceipt of cash assistance under this title unless the applicant:\n  (a) accepts final administrative and financial responsibility for\nmanagement of an effective food service;\n  (b) possesses a valid license or other approval issued by the\ndepartment, the department of social services or other state agency to\noperate or sponsor child or adult day care programs;\n  (c) has not been seriously deficient in its operation of the program\nor any other program specified in federal law, rule or regulation;\n  (d) demonstrates that it will provide adequate supervisory and\noperational personnel for overall monitoring and management of the\nprogram; and\n  (e) meets standards prescribed in federal law, rule or regulation.\n  3. The commissioner shall provide written notice of approval or\ndisapproval of the proposed application to the applicant.\n
