Transfer of officers and employees

§ 2755. Transfer of officers and employees. 1. In accordance with the\nprovisions of section seventy of the civil service law, any officer or\nemployee of the county, selected by the authority may, with the consent\nof the county executive, be transferred to the authority and shall be\neligible for such transfer and appointment, without further examination,\nto applicable offices, positions and employment under the authority.\n  2. A transferred employee shall remain in the same collective\nbargaining unit as was the case prior to his or her transfer; successor\nemployees to the positions held by such transferred employees shall,\nconsistent with the provisions of article fourteen of the civil service\nlaw, be included in the same unit as their predecessors. Employees\nserving in positions in newly created titles shall be assigned to such\nsame collective bargaining unit if they would have been assigned to such\nunit were such titles created prior to the establishment of the\nauthority. Nothing contained in this title shall be construed to\ndiminish (a) the rights of employees pursuant to a collective bargaining\nagreement or (b) to affect existing law with respect to an application\nto the public employment relations board seeking a designation by the\nboard that certain persons are managerial or confidential.\n
