§ 2642-j. New York state and local employees' retirement system rights\nof employees; civil service. 1. In accordance with the provisions of\nsection seventy of the civil service law, any officer or employee of a\nmunicipality transferred to the authority shall be eligible for such\ntransfer and appointment, without further examination, to applicable\noffices, positions and employment under the authority. Any such officers\nor employees so transferred to the authority pursuant to this section,\nwho are members of or benefit under any existing pension or retirement\nfund or system, shall continue to have all rights, privileges,\nobligations and status with respect to such fund or system as are now\nprescribed by law.\n 2. Nothing contained in this title shall be construed (a) to diminish\nthe rights of employees pursuant to a collective bargaining agreement or\n(b) to affect existing law with respect to an application to the public\nemployment relations board seeking a designation by the board that\ncertain persons are managerial or confidential.\n
