Actions or contracts involving certain nuclear power plants

§ 1005-a. Actions or contracts involving certain nuclear power plants.\nWhenever the authority undertakes or executes any action or contract\ninvolving the closure, maintenance, decommissioning or conversion of any\nnuclear power plant constructed by a utility corporation which has not\nentered commercial operation, the authority shall, in order to ensure\nthat neither the authority nor its customers shall bear any of the costs\nassociated therewith, provide for the full recovery from such\ncorporation, its successors or assigns of:\n  (a) all direct and indirect costs and expenses incurred by the\nauthority in connection with such actions or contracts;\n  (b) all direct and indirect costs incurred by the authority in\nconnection with damages to third parties resulting from any actions of\nthe authority in connection with such actions or contracts; provided,\nhowever, that the authority shall not be indemnified against damages for\ngross negligence or willful misconduct; and\n  (c) all damages incurred by the authority in connection with such\nactions or contracts other than damages resulting from its gross\nnegligence or willful misconduct.\n  In no event shall the authority recover any costs or damages related\nto such actions or contracts from any of its customers other than such\ncorporation its successors or assigns.\n
