§ 35.07 State agencies; coordination and cooperation. 1. The\ncommissioner, in carrying out his functions and responsibilities under\nthis title, shall consult with, cooperate with, and, to the maximum\nextent practicable, coordinate his activities with other interested\nstate agencies.\n  2. The following officers of state agencies with program\nresponsibilities that affect aspects of the interpretation,\npreservation, development and use of heritage areas resources shall\nprepare a program statement which shall detail actions in the areas of\nplanning, development, use, assistance and regulation that can support\nand assist the establishment and management of state heritage areas:\n  (a) Commissioner of parks, recreation and historic preservation\nregarding the state historic preservation program and for outdoor\nrecreation;\n  (b) Commissioner of economic development regarding the state tourism\nprogram and economic development activities;\n  (c) Commissioner of environmental conservation regarding the\nmanagement of natural resources within heritage areas;\n  (d) Commissioner of education regarding educational resources and\ntheir interpretation;\n  (e) Commissioner of transportation regarding access and transportation\nwithin state designated heritage areas;\n  (f) Secretary of state regarding neighborhood preservation programs,\nthe coastal zone management program and other planning and community\ndevelopment programs administered by the department of state, and\nregarding its activities for identifying and preserving rural resources;\n  (g) Commissioner of the office of general services regarding the\nmanagement and disposition of state property;\n  (h) Commissioner of the division of housing and community development\nregarding housing and neighborhood programs;\n  (h-1) President and chief executive officer of the power authority of\nthe state of New York regarding operation of the New York state canal\nsystem;\n  (h-2) Commissioner of agriculture and markets regarding agriculture in\nheritage areas;\n  (i) Director of the office of urban revitalization regarding its\nactivities for the revitalization of urban areas.\n  Such statements and revisions thereto shall be submitted to the\nheritage areas advisory council.\n  3. Where there is an approved management plan in effect, any state\nagency conducting, funding or approving activities directly affecting a\nheritage area shall consult with, cooperate with, and coordinate its\nactivities with the office and the appropriate local government. Any\nsuch state agency shall conduct or support such activities in a manner\nwhich is, to the maximum extent practicable, consistent with the\napproved management plan and reviews to determine consistency of state\nproposed actions with individual management plans. The heritage area\nprogram shall be incorporated as part of the reviews of actions pursuant\nto the state environmental quality review act as provided in article\neight of the environmental conservation law and the New York state\nhistoric preservation act of 1980. The office shall review and comment\nin writing upon the statement and effects on a state designated heritage\narea or the heritage area program, made pursuant to section 8-0109 of\nthe environmental conservation law or section 14.09 of this chapter.\n
