09 Convictions; bail forfeitures; failure to appear

§ 27. 09 Convictions; bail forfeitures; failure to appear.  1. The\ntrial court or clerk thereof shall certify to the commissioner the facts\nof any case involving a violation of any provision of this chapter, or\nof any rule, regulation, local law or ordinance adopted pursuant\nthereto,\n  (a) within five days of the date of conviction of such violation;\n  (b) within five days of a forfeiture of bail in such case; or\n  (c) within ninety days of a failure of the defendant to appear on the\ninitial date of appearance, or any adjourned date for appearance or\ntrial.\n  2. The commissioner may, by regulation, provide for the form and\ncontent of such certification and limit the violations for which cer-\ntifications shall be required. Such certifications shall be pre-\nsumptive evidence of the facts therein contained and may, in the dis-\ncretion of the commissioner, be recorded in the records of the office.\nIn the event a conviction which has been so recorded is subsequently\nreversed, the commissioner, upon receiving due notice thereof, shall\nrecord such fact in such records.\n  3. Upon the conviction of any person of a violation for which a\ncertification must be made to the commissioner, pursuant to this\nsection, the court or clerk shall also enter such conviction on any\nlicense or certificate issued by the office if such entry is required by\nthe regulations of the commissioner.\n
