Crematory operations during emergency declaration

* § 1518. Crematory operations during emergency declaration.\n  Notwithstanding any other provision of law, for the duration of a\nstate or county disaster emergency declared pursuant to an executive\norder, crematories located in any county of the state may provide\nemergency transportation and disposition assistance in such instances\nwhere the crematories in affected areas are inoperable or unable to\nprovide sufficient capacity for the disposition of human remains during\nany period of the declared emergency. Such crematories electing to\nprovide emergency assistance shall contract for or otherwise utilize any\nmode of transportation necessary to transport human remains from areas\nof a declared emergency to other crematory operations within the state\nwith cremation capacity. Transportation and disposition of human remains\nfrom such affected areas shall be conducted by any agent of the\nregulated crematory and shall only be permitted with a cremation permit\nrequired pursuant by section four thousand one hundred forty-five of the\npublic health law attesting to the permission for the cremation of the\ndeceased and their identity. In all instances of emergency crematory\noperations, a fully executed cremation authorization form shall\naccompany the human remains and provide the information necessary to\nreturn the cremated remains to the individual authorizing such\ncremation. Nothing in this section shall require a crematory to provide\nsuch transportation or additional crematory resources if they are unable\nto do so.\n  * NB There are 2 § 1518's\n
