§ 33. Deposit of refuse in navigable waters of the state. No person\nshall drain, deposit or cast any dead animal, carrion, offal, excrement,\ngarbage or other putrid or offensive matter into the navigable waters of\nthe state or any tidewaters bordering on or lying within the boundaries\nof Nassau and Suffolk counties, except as the same may be authorized by\nthe state department of health. Every person violating the provisions of\nthis section shall upon conviction by any court of competent\njurisdiction be guilty of a misdemeanor punishable by a fine of not to\nexceed one hundred dollars, or by imprisonment of not more than one\nyear, or by both such fine and imprisonment for each offense.  The\ndistrict attorney of the county, in which the offense is committed or\nexists, is authorized and directed to prosecute such offender or\noffenders.\n
