§ 5.09 Facilities development corporation.\n (a) The facilities development corporation shall be entitled to\nexclusive possession, jurisdiction, supervision and control of all real\nproperty held for facilities operated by any of the offices of the\ndepartment, such facilities being defined as mental hygiene facilities\nby section three of the facilities development corporation act, to\nexclusive possession, jurisdiction, supervision and control of such\nfacilities, and to all payments made for the care, maintenance and\ntreatment of patients at such facilities; provided, however, that the\ndirectors of the said corporation shall make all such property and all\nsuch facilities available to the commissioners and offices of the\ndepartment of mental hygiene for use in the care, maintenance, and\ntreatment of the mentally disabled.\n The provisions of this section shall not be applicable to community\nmental health and developmental disabilities facilities as defined in\nsection three of the facilities development corporation act or to\npayments made for the care, maintenance and treatment of patients at\nsuch community mental health and developmental disabilities facilities.\n (b) The director of a department facility shall permit any director,\nofficer, employee or agent of the facilities development corporation to\ninspect and test the physical condition of any building, unit, room,\nstructure, improvement, walkway, roadway, parking lot or utility\nconnection at the facility under appropriate conditions designed to\nminimize any disruption in the care, maintenance, and treatment of\npatients at the facility. The director and officers and employees at the\nfacility shall cooperate fully with any such trustee, officer, employee\nor agent in assessing the need for physical construction,\nreconstruction, rehabilitation and improvement at the facility and for\nthe acquisition of furnishings, equipment, machinery and apparatus to be\nused in mental hygiene facilities upon the completion of construction,\nreconstruction, rehabilitation or improvement work and shall cooperate\nfully in carrying out all work being done under the direction of the\nsaid corporation.\n
