§ 13.39 Registration and notification of boards of directors or trustees\n of certain voluntary not-for-profit facilities or\n corporations.\n (a) Notwithstanding any other law, rule or regulation, the executive\ndirector, chairperson or president of a voluntary, not-for-profit\ncorporation or facility which is subject to the jurisdiction of the\noffice for people with developmental disabilities shall furnish annually\nto the commissioner a list of the names and addresses of the current\nmembers of the board of directors or trustees of such facility or\ncorporation. Failure to furnish such annual list shall remove such\nfacility or corporation from consideration for recertification.\n (b) In the event that such facility or corporation is found to be in\nviolation of the provisions of this chapter or of rules and regulations\npromulgated by the commissioner pursuant to this chapter which could\nresult in the revocation, cancellation, limitation or suspension of the\noperating certificate of such facility and if notice of such violation\nis provided to the facility pursuant to such regulations, a copy of such\nnotice shall be provided to each of the current members of the board of\ndirectors or trustees of such facility or corporation by the\ncommissioner.\n (c) The commissioner is authorized to promulgate such rules and\nregulations as are necessary to implement the provisions of this\nsection.\n
