§ 13.01 Declaration of policy.\n The state of New York and its local governments have a responsibility\nfor the prevention and early detection of developmental disabilities and\nfor the comprehensively planned provision of services including care,\ntreatment habilitation and rehabilitation of their citizens with\ndevelopmental disabilities.\n Therefore, it shall be the policy of the state to conduct research and\nto develop programs to further the prevention and early detection of\ndevelopmental disabilities; to develop a comprehensive, integrated\nsystem of services which has as its primary purposes the promotion and\nattainment of independence, inclusion, individuality and productivity\nfor persons with developmental disabilities; to serve the full range of\nneeds of persons with developmental disabilities by expanding the number\nand types of community based services and developing new methods of\nservice delivery; and to improve the equity, effectiveness and\nefficiency of services for persons with developmental disabilities by\nserving persons in the community as well as those in developmental\ncenters, by improving the conditions in developmental centers, and by\nestablishing accountability for carrying out the policies of the state\nwith regard to such persons.\n To accomplish these goals and meet the particular needs of individuals\nwith developmental disabilities, a new autonomous agency to be known as\nthe office for people with developmental disabilities has been\nestablished. The office and its commissioner shall plan and work with\nlocal governments and voluntary organizations and all providers of\nservices, and individuals with developmental disabilities and their\nfamilies and representatives, to develop an effective, integrated,\ncomprehensive system for the delivery of all necessary supports and\nservices to all individuals with developmental disabilities and to\ncreate financing procedures and mechanisms to support such a system of\nsupports and services to ensure that all individuals with developmental\ndisabilities in need of supports and services receive appropriate and\ntimely supports and services close to their families and community. In\ncarrying out these responsibilities, the office and its commissioner\nshall make full use of existing services in the community, including\nthose provided by voluntary and other service organizations, and within\nannual amounts made available shall add in-home, residential and day\nservice and support capacity, to address the needs of individuals with\ndevelopmental disabilities.\n Any provisions of this article which explicitly or implicitly apply\nto, or reference, persons who are mentally retarded, shall be deemed to\napply to, or reference, persons with developmental disabilities.\n
