§ 94. Appointment of clerical and other assistants of appellate\ndivision in first department. The justices of the appellate division of\nthe supreme court in the first judicial department, or a majority of\nthem, are authorized to appoint and at pleasure remove a clerk, deputy\nclerk and all necessary other assistants in said court and to prescribe\nthe duties and fix the salaries thereof. Except as provided in the state\nfinance law, such salaries and all other necessary expenses of such\nappellate division, shall be audited by the state comptroller out of\nmoneys appropriated therefor by law. The state department of taxation\nand finance shall pay such salaries in equal biweekly installments and\nshall apportion the total amount of such salaries and expenses among the\ncounties comprising the first judicial department. Such counties shall\nreimburse the state for such salaries and expenses. The time and method\nof such reimbursement shall be as specified in section seventy-four of\nthis chapter. Provided, however, that the present deputy clerk,\nassistant clerks, confidential clerk, typewriter operators, crier and\nassistant to the crier of said appellate division shall be continued in\noffice.\n
