§ 92. General powers conferred upon presiding justice and appellate\ndivision in first department. Except as otherwise provided in this\narticle, all the powers heretofore conferred by law upon the presiding\njustice of the general term of the supreme court in the first judicial\ndepartment, the chief judge of the court of common pleas for the city\nand county of New York, and the chief judge of the superior court of the\ncity of New York, either or all of them, are vested in the presiding\njustice of the appellate division of the supreme court in the first\ndepartment. All the powers heretofore conferred by law upon the general\nterm of the supreme court in the first judicial department, upon the\ngeneral term of the superior court of the city of New York and upon the\ngeneral term of the court of common pleas for the city and county of New\nYork, are conferred upon and vested in the appellate division of the\nsupreme court in the first department. And all the powers conferred by\nlaw upon the supreme court in the first judicial district, upon the\nsuperior court of the city of New York and upon the court of common\npleas for the city and county of New York, other than as courts of first\ninstance in actions and special proceedings, are also conferred upon and\nvested in said appellate division.\n
