§ 469. Continuance where attorney is member of legislature. When a\nparty to a civil action or proceeding shows by his or his attorney's\naffidavit that his attorney is a member of the legislature of the state\nof New York, that the legislature is in regular or special session or\nthat not more than ten days have elapsed since the adjournment sine die\nof such session, that such attorney is the only one employed by the\nparty who is prepared to try the cause, and that due to the performance\nof his legislative duties he is then unable to try the cause, the court\nshall grant a stay of the trial without prejudice to its place on the\ncalendar, provided that no such stay shall extend to more than ten days\nafter the adjournment sine die of the session of the legislature.\n
