§ 265. Fees of clerk of appellate division; in each judicial\ndepartment; justices thereof to make rules. Notwithstanding any other\nprovision of law:\n (a) The clerk of the appellate division of the supreme court in each\njudicial department, for his official services shall be entitled to\nreceive for and on behalf of the state such reasonable fees as may be\nprescribed by rules as hereinafter provided. He shall account to the\nstate comptroller for the moneys from such fees and shall pay into the\nstate treasury all such moneys.\n (b) The justices of each appellate division or a majority of them\nshall have the power to make, from time to time, rules fixing and\nregulating the fees of the clerk of such appellate division, his\nundertaking, and all his duties in relation to such fees.\n
