§ 335. Implementation of hospital reimbursement methodology. The\nsuperintendent shall have the power to prescribe rules and regulations\ngoverning insurer procedures and subscriber contract provisions\nnecessary to implement a hospital reimbursement methodology established\nin accordance with the provisions of article twenty-eight of the public\nhealth law, and insurer procedures and subscriber contract provisions\nnecessary to implement a hospital inpatient discharge review program\nestablished in accordance with the provisions of section twenty-eight\nhundred three-i of the public health law, and to establish standards,\ncriteria and procedures for evaluation of insurer performance in\noffering contracts for hospital and medical benefits on an open\nenrollment basis necessary for a determination of the hospital payment\nrate conversion factor in accordance with the provisions of paragraph\n(i) of subdivision eleven of section twenty-eight hundred seven-c of the\npublic health law.\n  The superintendent shall periodically report his findings and\nconclusions to the commissioner of health and to the chairman and\nvice-chairman of the council on health care financing concerning insurer\nperformance in offering contracts for hospital and medical benefits on\nan open enrollment basis.\n
