§ 3236. Public health law assessments. Any insurer licensed pursuant\nto this chapter and any health maintenance organization certified\npursuant to article forty-four of the public health law or licensed\npursuant to this chapter shall reflect the methodology for financing the\ncosts of graduate medical education in general hospitals and affiliated\nsites, uncompensated care in general hospitals and diagnostic and\ntreatment centers, and other publicly financed programs established\npursuant to sections twenty-eight hundred seven-j, twenty-eight hundred\nseven-k, twenty-eight hundred seven-l, twenty-eight hundred seven-m,\ntwenty-eight hundred seven-p, twenty-eight hundred seven-s and\ntwenty-eight hundred seven-t of the public health law for hospital and\nother health care services provided on and after January first, nineteen\nhundred ninety-seven in policies and contracts which provide\nreimbursement for, and in arrangements reflecting anticipated claims\ncosts for, any of the following services:\n (a) inpatient hospital services provided by a general hospital issued\nan operating certificate pursuant to article twenty-eight of the public\nhealth law;\n (b) outpatient hospital services provided by a general hospital issued\nan operating certificate pursuant to article twenty-eight of the public\nhealth law;\n (c) emergency services provided by a general hospital issued an\noperating certificate pursuant to article twenty-eight of the public\nhealth law;\n (d) ambulatory surgical services provided by a general hospital issued\nan operating certificate pursuant to article twenty-eight of the public\nhealth law;\n (e) ambulatory surgical services provided by a diagnostic and\ntreatment center issued an operating certificate pursuant to article\ntwenty-eight of the public health law;\n (f) health care services provided by a diagnostic and treatment center\nissued an operating certificate pursuant to article twenty-eight of the\npublic health law;\n (g) clinical laboratory services provided by a clinical laboratory\nissued a permit pursuant to title five of article five of the public\nhealth law.\n
