§ 2334. Non-commercial private passenger automobile insurance rates;\nmerit rating plans. (a) The superintendent shall, after public hearing,\npromulgate a regulation, which may be amended from time to time,\napplicable to non-commercial private passenger automobile insurance\nmerit rating plans which reflect an individual driver's experience with\nrespect to accidents, claims or traffic violations. The regulation shall\ncontinue to encourage competition among insurers, but shall discourage\nmerit rating plan provisions which may tend to create confusion or\nmisunderstanding among insureds. The regulation shall establish\nstandards and limitations intended to insure that merit rating plans are\nreasonable, understandable and objective and are not unfairly\ndiscriminatory, inequitable, violative of public policy or otherwise\ncontrary to the best interests of the people of this state.\n (b) Insurers shall review their merit rating plans which were approved\nby the superintendent prior to the promulgation of the regulation\nrequired by this section and shall, before November first, nineteen\nhundred eighty-two, file with the superintendent statements that their\nmerit rating plans conform with the regulation, or file appropriate\namendments to their plans which will bring them into compliance with the\nstandards of the regulation. Such amendments shall become effective upon\napproval by the superintendent.\n
