New York Insurance Code § 2302

§ 2302. Applicability. (a) This article shall apply to all kinds of\ninsurance written on risks or operations in this state by an insurer\nauthorized to do business in this state except:\n  (1) reinsurance (other than joint reinsurance to the extent stated in\nsection two thousand three hundred seventeen of this article);\n  (2) accident and health insurance;\n  (3) annuities, life insurance, including provisions for\nnon-cancellable disability benefits in conjunction therewith;\n  (4) marine insurance (other than inland marine insurance and insurance\nupon automobiles, airplanes, seaplanes, dirigibles or other aircraft);\n  (5) marine protection and indemnity insurance;\n  (6) insurance issued by an assessment cooperative fire insurance\ncompany; and\n  (7) service contract reimbursement insurance.\n  (b) The superintendent may from time to time make investigations with\nrespect to classes of risks of the kinds of insurance exempted in\nparagraph one hereof and may call upon all authorized insurers and rate\nservice organizations making rates for such risks to furnish information\nrelative thereto.\n
