§ 44. The treasurer.  Within thirty days after his election and before\nperforming any of the duties or exercising any of the powers of his\noffice, the treasurer of each nation shall give a bond to such nation,\nwith such sureties and in such amount as the state comptroller shall\napprove, conditioned for the faithful performance of the duties of his\noffice. For any breach of the conditions of such bond, an action may be\nmaintained for the benefit of such nation, by their attorney, in the\nmanner provided by law for the breach of an official bond given by a\ncounty treasurer. If such bond is not given within the time provided,\nthe office shall be deemed vacant. The treasurer of the Seneca nation\nshall receive all moneys belonging to the nation, including the\nannuities paid by the government of the United States or the state of\nNew York. The treasurer of the Tonawanda nation shall receive all moneys\nbelonging to such band, which shall be deposited with him pursuant to\nany resolution of the council of such nation. The treasurer of each\nnation shall pay out moneys only upon a warrant, certified by the\npresiding officer and clerk of the council, to the effect that the\namount to be paid by such warrant was appropriated by a resolution\npassed by a majority vote of the council, which warrant the treasurer\nshall retain as a voucher. The treasurer shall receive such compensation\nas the council shall determine. At least five days before the annual\nelection, he shall report to the peacemakers an account of all moneys\nreceived and expended by him, with the vouchers for such expenditures,\nwhich account shall be settled by the peacemakers and read by the\npresiding officer at the next annual election.\n
