§ 219. Definitions. As used in this article: 1. "Town highway" shall\nmean highways constructed, improved or maintained by the town with the\naid of the state or county, under the provisions of the highway law,\nincluding all highways in towns, outside of incorporated villages\nconstituting separate road districts, except state highways, county\nroads, parkways, state thruways and controlled access highways as\ndefined by the highway law.\n  2. "Project" shall mean a town highway improvement, repair or\nreconstruction.\n  3. "Approved project" shall mean a project approved as provided by\nthis article.\n  4. "Plan" shall mean a map and specifications showing (a) the location\nof a project, (b) the estimated cost of such project, (c) the proposed\nwidth, thickness and type of highway, (d) a statement of necessity for\nsuch project relied upon by the town, and (e) the projects to be\ncompleted in each year of the period of the duration of this article.\n  5. "Commissioner" shall mean the commissioner of transportation of the\nstate of New York.\n  6. "County superintendent" shall mean the county superintendent of\nhighways.\n  7. "Town superintendent" shall mean the town superintendent of\nhighways.\n  8. "Highway" shall include necessary sluices, drains, ditches,\nwaterways, embankments, retaining walls, bridges on such highway and\nunder the jurisdiction and control of the town and culverts, and the\napproaches of any such bridge or culvert beginning at the back of the\nabutments.  The term does not include sidewalks or boardwalks or\nrenewals thereof.\n  9. "Board of supervisors" shall mean the elective governing body of a\ncounty, by whatever name designated.\n  10. "Roadbed" shall mean the portion of the highway, improved,\ndesigned or ordinarily used for vehicular travel, exclusive of the berm\nor shoulder.\n  11. "Bridge" shall mean any structure whether of single or multiple\nspan construction with a clear span in excess of five feet with\nmeasurements to be made in the manner set forth in subdivision two of\nsection two hundred thirty of this chapter.\n  12. "Culvert" shall mean any structure whether of single or multiple\nspan construction with an interior width of five feet or less with\nmeasurements to be made in the manner set forth in subdivision two of\nsection two hundred thirty of this chapter.\n
