* § 890-b. County of Cattaraugus industrial development agency. 1. For\nthe benefit of the county of Cattaraugus and the inhabitants thereof, an\nindustrial development agency, to be known as the COUNTY OF CATTARAUGUS\nINDUSTRIAL DEVELOPMENT AGENCY, is hereby established for the\naccomplishment of any or all of the purposes specified in title one of\narticle eighteen-A of this chapter. It shall constitute a body corporate\nand politic, and be perpetual in duration. It shall have the powers and\nduties now or hereafter conferred by title one of article eighteen-A of\nthis chapter upon industrial development agencies and such agency shall\ntake into consideration the local zoning and planning regulations as\nwell as the regional and local comprehensive land use plans. It shall be\norganized in a manner prescribed by and be subject to the provisions of\ntitle one of article eighteen-A of this chapter. Its members shall be\nappointed by the governing body of the county of Cattaraugus. The\nagency, its members, officers and employees and its operations and\nactivities shall, except as provided specifically herein, be governed by\nthe provisions of title one of article eighteen-A of this chapter.\n  2. In addition to the powers and duties now or hereafter conferred by\ntitle one of article eighteen-A of this chapter, the agency shall have\nthe power (i) to acquire, construct, own, maintain, and lease or sell to\na railroad or private business corporation any interest in railroads\noperated wholly or partially within Cattaraugus county, including\neasements or rights of way, necessary switching apparatus, track, and\nother equipment necessary or convenient to the operation of such\nrailroad, which will be used in conjunction with industrial,\nmanufacturing, commercial or warehousing operations and (ii) to finance\nsuch facilities through the issuance of its bonds and notes, when in the\njudgment of the agency, such facilities will serve to promote, develop,\nencourage and assist in the acquiring, constructing, reconstructing,\nimproving, maintaining, equipping and furnishing of industrial,\nmanufacturing, warehousing, commercial, and research facilities\nincluding industrial pollution control facilities and thereby advance\nthe job opportunities, health, general prosperity and economic welfare\nof the people of the state and improve their prosperity and standard of\nliving.\n  * NB Agency expires per §§ 856 and 882\n
