§ 71-a. Injury or death of person aiding a police officer or peace\nofficer. A person who, after having been lawfully commanded to aid a\npolice officer or peace officer in effectuating or securing an arrest or\nin preventing the commission by another of any offense, is killed or\ninjured or his property or that of his employer is damaged and such\ndeath, injury or damage arises out of and in the course of aiding such\nofficer, the person or employer so injured or whose property is so\ndamaged or the personal representatives of the person so killed shall\nhave a cause of action to recover the amount of such damage or injury\nagainst the municipal corporation by which such officer is employed at\nthe time such command is obeyed. In the event of the death of the person\nso commanded to aid an officer, the action shall be governed by the\nprovisions of part four of article five of the estates, powers and\ntrusts law.\n
