§ 899-ll. Scope. 1. This article shall apply to conduct that occurs in\nwhole or in part in the state of New York. For purposes of this article,\ncommercial conduct takes place wholly outside of the state of New York\nif the business collected such information while the covered user was\noutside of the state of New York, no part of the use of the covered\nuser's personal data occurred in the state of New York, and no personal\ndata collected while the covered user was in the state of New York is\nused.\n  2. Nothing in this article shall be construed to prohibit an operator\nfrom storing a covered user's personal data that was collected pursuant\nto section eight hundred ninety-nine-ff of this article when such\ncovered user is in the state.\n  3. Nothing in this article shall be construed to impose liability for\ncommercial activities or actions by operators subject to 15 U.S.C. 6501\nthat is inconsistent with the treatment of such activities or actions\nunder 15 U.S.C. 6502.\n
