§ 1023. Procedure for issuance of temporary order. Any person who may\noriginate a proceeding under this article may apply for, or the court on\nits own motion may issue, an order of temporary removal under section\none thousand twenty-two or one thousand twenty-seven or an order for the\nprovision of services or assistance, including emergency medical or\nsurgical procedures pursuant to subdivision (c) of section one thousand\ntwenty-two, or a temporary order of protection pursuant to section ten\nhundred twenty-nine. The applicant or, where designated by the court,\nany other appropriate person, shall make every reasonable effort, with\ndue regard for any necessity for immediate protective action, to inform\nthe parent or other person legally responsible for the child's care of\nthe intent to apply for the order, of the date and the time that the\napplication will be made, the address of the court where the application\nwill be made, of the right of the parent or other person legally\nresponsible for the child's care to be present at the application and at\nany hearing held thereon and, of the right to be represented by counsel,\nincluding procedures for obtaining counsel, if indigent.\n
