§ 550. Definitions. As used in this article, the following terms shall\nhave the following meanings:\n 1. "Executive director" shall mean the executive director of the\njustice center for the protection of people with special needs.\n 2. "Mental hygiene facility" shall mean a facility as defined in\nsubdivision six of section 1.03 of the mental hygiene law and facilities\nfor the operation of which an operating certificate is required pursuant\nto article sixteen or thirty-one of the mental hygiene law and including\nfamily care homes. "Mental hygiene facility" also means a secure\ntreatment facility as defined by article ten of the mental hygiene law.\nThis term shall not include services defined in subparagraph four of\nsubdivision (a) of section 16.03 of the mental hygiene law.\n 3. "Reportable incident" shall have the same meaning as defined in\nsubdivision one of section four hundred eighty-eight of the social\nservices law.\n 4. "State oversight agency" shall mean the state agency that operates,\nlicenses or certifies an applicable facility or provider agency as\ndefined in subdivision four of section four hundred eighty-eight of the\nsocial services law; provided however that such term shall only include\nthe following entities: the office of mental health, the office for\npeople with developmental disabilities, the office of alcoholism and\nsubstance abuse services, the office of children and family services,\nthe department of health and the state education department. "State\noversight agency" does not include agencies that are certification\nagencies pursuant to federal law or regulation. For purposes of this\narticle, "state oversight agency" shall include the justice center for\nthe protection of people with special needs.\n 5. "Vulnerable person" shall mean a person who, due to physical or\ncognitive disabilities, or the need for services or placement, is\nreceiving services from a facility or provider agency as defined in\nsubdivision four of section four hundred eighty-eight of the social\nservices law.\n 6. "Individual with a disability," except as used in subdivision (b)\nof section five hundred fifty-eight of this article, shall mean a person\nwith a disability as defined in subdivision twenty-one of section two\nhundred ninety-two of this chapter.\n
