§ 23-b. Nursing home and assisted living facility plans. 1. After\nconsultation with the commissioner of health, the director of the office\nfor the aging, and the director of the state office of homeland\nsecurity, the commission shall establish standards for nursing homes,\nadult homes, enriched housing programs and assisted living residences\nregarding disaster preparedness.\n 2. Each such facility shall be assisted in the establishment of a\ndisaster preparedness plan. The plan shall include, but not be limited\nto, the following:\n (a) Maintaining a supply of food, water and to the extent deemed\nnecessary and feasible in the reasonable judgment of the operator of the\nfacility, medication in reserve in the event that obtaining such items\nshould become difficult or impossible.\n (b) In the reasonable judgment of the facility, having access to a\ngenerator or generators sufficient to supply electrical power to the\nfacility.\n (c) Establishing an evacuation plan for residents including an\nalternative site suitable for temporary use.\n (d) Establishing staffing plans during a disaster.\n 3. Such plans shall be made available to the county emergency\nmanagement office.\n 4. Nothing in this section shall be deemed to modify or override any\nrequirements in regulations duly promulgated by a state agency, or to\nlimit any lawful authority of a state agency to promulgate regulations,\nwith respect to disaster preparedness of such facilities, the contents\nof their disaster preparedness plans or the process for approval of\nthose plans.\n
