* § 3-6.2 Definitions\n For purposes of this part the following terms shall have the following\nmeanings:\n (a) "Audit trail data" means data about the activities of data,\nincluding but not limited to the electronic will's creation and\nexecution.\n (b) "Communication technology" means an electric device or process\nthat allows two or more remotely located individuals to communicate with\neach other simultaneously by sight and sound.\n (c) "Electronic" shall have the same meaning set forth in subdivision\none of section three hundred two of the state technology law.\n (d) "Electronic presence" means the relationship of two or more\nindividuals in different locations communicating in real time using\ncommunication technology to the same extent as if the individuals were\nphysically present in the same location.\n (e) "Electronic will" means a will executed electronically in\ncompliance with paragraphs (a) and (b) of section 3-6.6 and subsequently\nfiled with the New York state unified court system in accordance with\nsection 3-6.9.\n (f) "Record" means information that is inscribed on a tangible medium\nor that is stored in an electronic or other medium and is retrievable in\nperceivable form.\n (g) "Sign", with respect to an electronic record, means, with present\nintent to authenticate or adopt a record to affix to or logically\nassociate with the record an electronic symbol or process.\n (h) "State" means a state of the United States, the District of\nColumbia, Puerto Rico, the United States Virgin Islands, or any\nterritory or insular possession subject to the jurisdiction of the\nUnited States. The term shall also include a federally recognized Indian\ntribe.\n (i) "Will" has the same meaning as in section 1-2.19.\n * NB Effective December 12, 2027\n
