Punishment for violations of title 5 of article 15

§ 71-1107. Punishment for violations of title 5 of article 15.\n  1. A violation of section 15-0501, 15-0503 or 15-0505, shall\nconstitute a misdemeanor, punishable by a fine of not to exceed ten\nthousand dollars, or by imprisonment not to exceed one year or by both\nsuch fine and imprisonment and, in addition thereto, by a civil penalty\nof not more than five thousand dollars.\n  2. A subcontractor, employee or agent of such person or public\ncorporation, or of a state department who knowingly and intentionally\nacts, or a prime contractor of such person, public corporation or state\ndepartment who acts with or without an intention to violate the\nprovisions of title 5 of article 15, in disregard of specifications\nprovided in a construction contract protecting against stream damage,\nshall be guilty of a violation punishable by a fine of not less than\ntwenty-five dollars, nor more than two hundred fifty dollars, or by\nimprisonment for not more than fifteen days, or by both such fine and\nimprisonment, and, in addition, thereto, by a civil penalty of not more\nthan five thousand dollars.\n
