Recovery of state assistance

§ 56-0507. Recovery of state assistance.\n  1. A municipality receiving state assistance under this title\nundertakes an environmental restoration project as agent of the state\nwith respect to the incurrence of eligible costs.\n  2. The state shall make all reasonable efforts to recover the full\namount of any state assistance provided under this title through\nlitigation brought under this section or other statute or under the\ncommon law, or through cooperative agreements, with responsible parties\n(other than the municipality to which state assistance was provided\nunder this title; or a successor in title, lender, or lessee who was not\notherwise a responsible party prior to the municipality's taking title\nto such property).\n  3. Any and all monies recovered or reimbursed pursuant to this section\nshall be deposited into the environmental restoration project account of\nthe hazardous waste remedial fund established under section\nninety-seven-b of the state finance law.\n
