Acquisition and dedication of real property

§ 45-0113. Acquisition and dedication of real property.\n  1. For the purposes of this article, the department may, when\nauthorized by an act of the legislature, and when funds are available\ntherefor, acquire in the name of the people of the state of New York fee\ntitle or any lesser interest in real property by any method of\nacquisition, including, but not limited to, appropriation, condemnation,\npurchase, conditional or unconditional gift, bequest or devise, in\naccordance with any powers of the department to acquire real property.\n  2. Only real property owned by the state or real property acquired\nunder this article or sections 51-0705, 52-0701 or 52-0901, or articles\nfifty-four and fifty-six of this chapter, or real property dedicated to\nthe Albany Pine Bush preserve pursuant to article forty-six of this\nchapter may be dedicated for the purposes of this article. Such\ndedication may be effected only by law.\n
